Welcome to Oracular. These Terms of Service ("Terms") govern your access to and use of our astrology website, mobile applications, and related services (collectively, the "Services"). By accessing or using our Services, including signing in to any of our applications, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

Important Notice: Our Services provide astrological information for entertainment and educational purposes only. We do not provide medical, psychological, financial, legal, or any other professional advice. All astrological calculations and predictions are for informational purposes only.

Oracular provides the following services:

4.2 Non-Refundable Nature

ALL PURCHASES OF DIGITAL TOKENS, CREDITS, OR PREMIUM SERVICES WITHIN ANY OF OUR APPS AND OTHER SERVICES ARE FINAL AND NON-REFUNDABLE. This includes, but is not limited to, cases where you are dissatisfied with an astrological response or prediction.

4.3 Currency and Payment Methods

We support multiple currencies including USD, INR, and others. Payments are processed through various partners and solution providers (e.g., Apple App Store, Google Play Store). You agree to pay all applicable fees and charges associated with your use of paid Services.

5. Partner Integrations

Our Services may integrate with or be provided through various partners and solution providers, including:

  • Mobile app stores and distribution platforms

These partners operate independently and have their own terms of service and privacy policies. We are not responsible for the actions or policies of these third parties.

You agree not to use our Services to:

8. Disclaimers

8.1 NOT LIFE ADVICE

CRITICAL NOTICE: OUR SERVICES DO NOT PROVIDE MEDICAL, PSYCHOLOGICAL, FINANCIAL, LEGAL, INVESTMENT, OR ANY OTHER PROFESSIONAL "LIFE ADVICE." All astrological information is provided for ENTERTAINMENT AND EDUCATIONAL PURPOSES ONLY. You should never make significant life decisions (including those related to health, finances, or relationships) based on any response provided by our Services.

8.2 No Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We make no representations or warranties regarding the accuracy, reliability, or completeness of astrological calculations or predictions.

8.3 No Liability for Results

We are NOT liable for any actions you take or decisions you make based on the content provided by our Services. The interpretation of astrological data is subjective and varies greatly.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORACULAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to:

  • Loss of profits, revenue, or data
  • Personal injury or emotional distress
  • Financial losses or investment decisions
  • Relationship or life decisions made based on our Services
  • Any damages arising from your use of our Services

Our total liability to you for any claims arising from your use of our Services shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold Oracular, its affiliates, officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses arising from your use of our Services, violation of these Terms, or infringement of any rights of another party.

11. Termination and Account Suspension

We reserve the right, in our sole discretion, to terminate or suspend your access to our Services (including all our apps and your Oracular account) at any time, for any reason, and without prior notice. This includes, but is not limited to, breach of these Terms, suspected fraudulent activity, or behavior that we deem harmful to other users or our operations.

NO REFUNDS UPON TERMINATION: In the event of account termination or suspension for any reason, you shall not be entitled to any refund or reimbursement for digital tokens, credits, subscription fees, or premium services already purchased. Any remaining balances shall be forfeited.

Upon termination, your right to use our Services will cease immediately. All provisions of these Terms that by their nature should survive termination (including disclaimers, indemnity, and limitations of liability) shall survive.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, specifically within the jurisdiction of Gujarat, without regard to its conflict of law provisions.

12.1 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Vadodara, Gujarat, India.

12.2 Class Action Waiver

YOU AND ORACULAR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of our Services after such changes constitutes acceptance of the updated Terms.

15. AI & Chat Feature Provisions

The following provisions apply specifically to the use of AI chat features, question-answering services, and proprietary analysis engines within any of our applications:

  • Acceptance by Interaction: By signing in, submitting a question, selecting a category, or providing birth data within any of our apps, you explicitly agree to these Terms and our Privacy Policy in their entirety. Each interaction constitutes a separate agreement to these terms.
  • Data Privacy: When asking questions, we do not share any personal identifiable data with external providers or any AI LLMs. We only provide calculated data which is not attached to any personal information.
  • Use at Own Risk: You acknowledge that our apps use Large Language Models (LLMs) and algorithms to synthesize astrological data. AI can hallucinate and produce content that is factually incorrect, biased, or nonsensical. All results are provided "as-is" and you use them entirely at your own risk.
  • No Liability for Responses: Oracular and its developers shall not be held liable for any emotional distress, psychological impact, or perceived "negative" predictions resulting from the analysis or any AI-generated responses.
  • Data Accuracy: You are responsible for ensuring your birth data (Time, Date, Place) is accurate. Inaccurate data will lead to inaccurate analysis, for which we bear no responsibility.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

18. Entire Agreement

These Terms, including any legal notices and disclaimers contained on our Services, constitute the entire agreement between Oracular and you in relation to your use of our Services, and supersede all prior agreements and understandings with respect to the same.

By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You also acknowledge that astrology is not a scientifically proven method and should not be relied upon for making important life decisions.
